This Agreement contains the complete list of Terms and Conditions which apply to an individual or entity or any other item that registers as Material (defined below) Seller(s) on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in website or/and MyHeavenHome's Material Seller Android or/and iOS application(s) or/and MyHeavenHome's Seller Android or/and iOS application(s) [MyHeavenHome mobile application(s) or/and our applications].
In this Agreement, the terms "company", "we", "us", or "our" (all are case insensitive) means MyHeavenHome Realty and Infra Solutions Private Limited or any of its affiliate; parent; or group companies and its successors and assigns or/and www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in website or/and MyHeavenHome's Seller Android or/and iOS application(s)or/and MyHeavenHome's Material Seller Android or/and iOS application(s) as the case may be, and "you" (case insensitive) means the applicant [an individual or entity or end-user or any other item that registers as Material Seller(s) or/and Seller].
"material" (case insensitive) means any construction material used for construction of the plot, house, villa, apartment, site, flat or/and any building.
Following terms and conditions will be deemed to have been accepted by the Material Seller (User) on usage of the www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s) without limitation or qualification.
You are requested to read them and other policies (including but not limited to privacy policy, disclaimer, shipping policy, return, replace and cancellation policy, intellectual property, product purchase process, payments and logistics partners info. etc.) carefully before you use the services of our applications.
www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s) is owned, maintained and monitored by MyHeavenHome Realty and Infra Solutions Private Limited. The use of www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Material Seller mobile application(s) is at the sole risk of the person or entity accessing any material on the www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s).
1. Material Seller Registration
You should be 18 year old or older to register as Material Seller. To begin the registration, you will provide all necessary information on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in website or/and MyHeavenHome\’s Seller mobile application(s). We will evaluate your information and will notify you of it is approved or rejected.
It is our sole discretion to approve or reject your information. We may reject it if your information is not suitable to our application(s). Your information should not contain any or/and all (but not limited to) the following contents:
o Illicit/illegal information
o Sex, region, race, religion, nationality, sexual orientation, age, gender, disability, pornography, sexually explicit materials
o Virus or malware or any robot program(s) or / and links
o Illicit/illegal audio or / and video files
o By using any tools or / and scripts directly adding the content(s) or / and product(s) to the buyer's shopping cart
o Information that violates any intellectual property rights
o Hatred messages, violence promotion
o Misleading or wrong information about the products, related to you.
As a registered Material Seller, you are allowed to list your house/building construction materials for sale on our applications as per the Policies that are incorporated by way of reference in this Terms of Use.
You must be legally eligible to sell the house/building construction materials you list for sale on our applications.
You must ensure that the listed house/building construction materials (including but not limited to text, graphics, images, pictures, links, video and audio) do not infringe upon trade secret or / and the intellectual property or / and other proprietary rights or rights of publicity or privacy rights of any third parties.
The house/building construction materials listings should contain only textual descriptions, links, images, graphics, video, audio and pictures that describe your sale of house/building construction materials.
All listed house/building construction materials should be listed in the respective group / category of our applications.
As a material seller, you are responsible for paying Value Added Tax (VAT), Tax Deduction at Source (TDS), Tax Collection at Source (TCS), Service Tax, Cess, Goods and Services Tax (GST) or/and any other taxes (including but not limited to state, central or/and integrated or/and composite) related to your business transaction or/and to your usage of our applications as necessitated by Indian laws.
Our applications or/and MyHeavenHome Realty and Infra Solutions Private Limited are not responsible if you (Material Seller) don't pay such required taxes or obtain the licenses for doing the business transactions on our applications.
If any penalties or/and consequences arise due to Material Seller's not compliance with the laws of India, it is sole Material Seller's responsibility to pay or face those penalties or/and consequences at any time. Our applications or/and MyHeavenHome Realty and Infra Solutions Private Limited are not responsible for these issues.
Material Seller agrees to provide all the necessary documents or/and licenses or/and other support information to our applications or/and MyHeavenHome Realty and Infra Solutions Private at any time related to Material Seller's business for which (s)he / entity is using our applications.
Material Seller agrees that our applications or/and MyHeavenHome Realty and Infra Solutions Private Limited can charge certain amount towards Shipping Charges, Collection Charges, Fixed Commission, Variable Commission, Cancellation Charges, Subscription Charges, Packing Charges, Storage Charges, Return Charges, Payment Gateway Charges, Facilitation Center Charges, EMI Convenience Charges, Fee Discount, Advertisement Charges, Same Day / Next Day Delivery Charges, Service Cancellation Charges, Samples at Door Steps Charges, Loading and Unloading Charges, service tax, Goods and Services Tax and any other charges that are applicable from time to time.
Our applications or/and MyHeavenHome's mobile application(s) or MyHeavenHome Realty and Infra Solutions Private Limited will notify the Material Seller(s) about these charges and Material Seller(s) can make the decision to continue to utilize the services of our applications or MyHeavenHome Realty and Infra Solutions Private Limited.
Material Seller(s) agrees all the terms and conditions (available in our applications or/and MyHeavenHome.com) for product cancellation, product return policies and any other product related activities.
The house/building construction materials\’ description should not mislead and should contain actual condition of the house/building construction materials.
You agree not to list a single house/building construction material in multiple quantities across various categories on our applications.
We reserve the right to delete such multiple listings of the same house/building construction materials listed by you in various categories.
Material Seller agrees that we can change/cancel/delete/add the contents (including but not limited to the property description, details and any other information [except the price and discount]) of house/building construction materials listed on our applications at any time.
Material Seller agrees that we can share the information of the Material Seller with any government organization of any country in world if the respective law of land demands/asks/requests.
We have the liberty to cancel the Material Seller's registration if his/her information or/and his/her house/building construction materials information is incorrect even after the Material Seller's or/and his/her house/building construction materials have been approved.
Material Seller agrees that (s)he read and understand the Privacy Policy and other policies related to our applications.
Material Seller agrees that we or/and our representative(s) / employee(s) can have the right to inspect the house/building construction materials on behalf of the Buyer and may change/delete the house/building construction materials listing at any time later if the house/building construction materials are found to be not meeting the standards of our applications.
2. Payment
Any of the payment method/s used on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s), MyHeavenHome Realty and Infra Solutions Private Limited won't be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to exceeding the limit mutually agreed by You and between Your bank(s) or / and lack of authorization for any transaction(s) or / and any payment issues arising out of the transaction or / and decline of transaction for any other reason(s). All the payments on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s) should be in Indian Rupees currency that are acceptable in the Republic of India. No other currency will be allowed on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s).
The payment schedule will be provided to the Material Seller while signing the agreement or/and Memorandum of Understanding. This payment schedule will be changed on need basis and will be informed to the Material Seller through www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller or/and MyHeavenHome's Material Seller mobile application(s) or/and e-mail or/and in person. It is the responsibility of the Material Seller to know the payment schedule on his/her/its own.
All the payments to the Material Seller will be made through electronic funds transfer or/and bank cheque to the Material Seller's bank account that has been provided during the registration.
It is the responsibility of the Material Seller to maintain accurate and correct information about his/her profile (registration data) and bank account data on our applications.
Material Seller has to ensure that the registration data has to be up to date. We under any circumstances are not responsible if Material Seller's data is stolen or/and hacked due to issues from Material Seller's computer or/and mobile phone or any device that is used by Material Seller to access www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Material Seller mobile application(s).
These terms and conditions will be updated on regular basis and Material Seller's continued use of the www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Material Seller mobile application(s) will be deemed an acceptance of these terms and conditions.
3. Indemnity
You agree to indemnify, defend and hold us harmless from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, arising out of or relating to any misuse by you of the content and services provided on the our applications. Please note that all the calculators (like tax, miscellaneous charges etc.) in www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's Seller mobile application(s) are for Material Seller's (User's) information purpose only. It is the responsibility of the Material Seller to calculate the tax, miscellaneous charges or any other applicable taxes or/and charges properly and we are not responsible for any mistakes in calculations.
4. Governing law
These terms and conditions are governed by and must be interpreted in accordance with Indian laws. You agree to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India in respect of any proceedings in connection with these terms and conditions.
You are responsible for complying with the laws of the jurisdiction from which you are accessing our applications and you agree that you will not access or use the information on our applications in violation of such laws. If any of these provisions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the terms and conditions which will continue in full force and effect.

6. No liability for damages

Internet connection and Google Play Store or/and Apple App Store (and any other required software or/and hardware) are required to run our applications and hence, you agree that you have Internet Connection and Google Play Store or/and Apple App Store (and any other required software or/and hardware) on your device (Computer, Mobile, Tablet, Laptop, any electronic device etc.), using which you are connecting to the our applications.
You agree that you take care of your mobile, e-mail credentials, mobile phone SIM access details and all the technical related software or/and hardware to access our applications. You agree that you logout of our applications after usage and regularly scan your devices (using which you access our applications) by using most powerful anti-virus and anti-intruder software and remove any virus or/and unwanted software.
9. Nature of Information

You must ensure that the listed properties/property do not infringe upon trade secret or / and the intellectual property or / and other proprietary rights or rights of publicity or privacy rights of any third parties.
The properties/property listings should contain only textual descriptions, graphics, videos and pictures that describe your sale properties/property.
All listed properties/property should be listed in the respective group / category of our applications.
The properties/property description should not mislead and should contain actual condition of the properties/property.
You agree not to list a single property in multiple quantities across various categories on our applications.
We reserve the right to delete such multiple listings of the same properties/property listed by you in various categories.
Property Seller agrees that we can change/cancel/delete/add the contents (including but not limited to the property description, details and any other information [except the price, maintenance charges and discount] of properties/property listed on our applications at any time.
Property Seller agrees that we can share the information of the Property Seller with any government organization of any country in world if the respective law of land demands/asks/requests.
We have the liberty to cancel the Property Seller's registration if his/her information or/and his/her properties/property information is incorrect even after the Property Seller's or/and his/her properties/property has been approved.
Property Seller agrees that (s)he read and understand the Privacy Policy and other policies related to our applications.
Property Seller agrees that we or/and our representative(s) / employee(s) can have the right to inspect the property on behalf of the potential Buyer (person or/and entity that is planning to purchase the property) and may change/delete the property listing at any time later if the properties/property are/is found to be not meeting the standards of our applications.
2. Payment
Any of the payment method/s used on www.MyHeavenHome.com and/or www.MyHeavenHome.co.in and/or www.MyHeavenHome.in or/and MyHeavenHome's mobile application(s), MyHeavenHome Realty and Infra Solutions Private Limited won't be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to exceeding the limit mutually agreed by You and between Your bank(s) or / and lack of authorization for any transaction(s) or / and any payment issues arising out of the transaction or / and decline of transaction for any other reason(s). Buyer agrees that we can charge certain amount towards Shipping Charges, Collection Charges, Cancellation Charges, Subscription Charges, Packing Charges, Return Charges, Payment Gateway Charges, Facilitation Center Charges, EMI Convenience Charges, Same Day / Next Day Delivery Charges, Service Cancellation Charges, Samples at Door Steps Charges, Loading and Unloading Charges, service tax, Goods and Services Tax and any other charges that are applicable from time to time.
Buyer agrees all the terms and conditions (provided on our applications) for product cancellation, product return policies and any other product related activities.
Buyer agrees that we can change/cancel/delete/add the contents (including but not limited to the product description, tax, coupon offer, order details and any other information except the product price, seller\’s discount and maintenance charges) of our applications at any time.

2. Payment

You should be the owner of the vehicle or/and equipment. All the taxes related to usage of the vehicle or/and equipment should be paid by you and should be up to date. As and when it is required we have the liberty to ask you provide the tax paid receipts or/and any other documents related to the concerned vehicle or/and equipment.
There should no criminal or any legal cases against you or your vehicle or/and equipment.
If you are providing the driver(s) or/and helper(s) or/and operator(s) then (s)he should be 18 year or older, (s)he should have valid driving license to use the vehicle or/and equipment, (s)he should not have any criminal cases or any legal cases against him/her.
The vehicle or/and equipment should be in good working condition and if any repairs or/and damage occur during the usage of it by us, the repair or/and damage costs should be borne by you and we are not responsible for repairs.
If there is any vehicle or/and equipment theft then you should be responsible to claim the insurance amount (paid by you) and we are not responsible for any claims.
If buyer (whoever hires your vehicle(s) or/and equipment(s) or/and any person / organization / any entity that needs Vehicle's or/and Equipment's services) is hiring or if we hire your vehicle then you are responsible to deliver the products that carried by your vehicle or/and equipment to the buyer's place then you are responsible to deliver the products to the buyer's place on time and we should be free from any damage. If any damage occurs to the carrying products, the equal amount of the price of the products will be collected from you.
As a Vehicle or/and Equipment Owner, you are responsible for paying Value Added Tax (VAT), Service Tax, Goods and Services Tax (GST) or/and any other taxes related to your business or/and your usage of our applications as necessitated by Indian laws.
We are not responsible if you (Vehicle or/and Equipment Owner) doesn't pay such required taxes or obtain the licenses for doing the business on our applications.
If any penalties or/and consequences arise due to Vehicle or/and Equipment Owner's not compliance with the laws of India, it is sole Vehicle or/and Equipment Owner's responsibility to pay or face those penalties or/and consequences and at any time we are not responsible for these issues.
Vehicle or/and Equipment Owner agrees to provide all the necessary documents or/and licenses or/and other support information to us at any time related to Vehicle or/and Equipment Owner's business for which (s)he / entity is using our applications.
Vehicle or/and Equipment Owner agrees that we can charge certain amount towards subscription, transaction, commission, fixed fee, packing & shipping charges, collection charges, service tax, GST and any other charges that are applicable from time to time.
We will notify the Vehicle or/and Equipment Owner(s) about these charges and Vehicle or/and Equipment Owner(s) can make the decision to continue to utilize the services of our applications.
Vehicle or/and Equipment Owner agrees that we can share the information of the Vehicle or/and Equipment Owner with any government organization of any country in world if the respective law of land demands/asks/requests.
We have the right to inactivate (or permanently delete) the Vehicle or/and Equipment Owner's account or/and any information pertaining to the Vehicle or/and Equipment Owner or/and his/her data.
We have the liberty to cancel the Vehicle or/and Equipment Owner's registration if his/her information is incorrect even after the Vehicle or/and Equipment Owner's details have been approved.
Vehicle or/and Equipment Owner agrees that (s)he read and understand the Privacy Policy and other policies related to our applications.
We can\’t interfere regarding any transaction(s), dispute(s) or any other deals that occur between the Vehicle or/and Equipment Owner and the potential buyer (buyer means person / organization / any entity that needs Vehicle's or/and Equipment's services). Hence, it is the sole responsibility of the Vehicle or/and Equipment Owner to deal with the potential buyer.
2. Indemnity
You agree to indemnify, defend and hold us harmless from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, arising out of or relating to any misuse by you of the content and services provided on our applications.
3. Governing law
These terms and conditions are governed by and must be interpreted in accordance with Indian laws. You agree to the exclusive jurisdiction of the courts of [Bengaluru/Bangalore, Karnataka, India] in respect of any proceedings in connection with these terms and conditions of our applications.

In particular, no warranty regarding non-infringement, security, accuracy, fitness for a purpose or freedom from computer viruses is given in connection with such information and materials and access to our applications.

7. Usage
You agree that you will not use our applications for any purpose that is unlawful or is prohibited by these terms and conditions. You also agree that our applications will not be used in any manner that could damage, disable others.
We reserve the right to modify these terms and conditions at any time, and such modifications shall be effective immediately upon their posting on our applications.
Internet connection and Google Play Store or/and Apple App Store (and any other required software or/and hardware) are required to run our applications and hence, you agree that you have Internet Connection and Google Play Store or/and Apple App Store (and any other required software or/and hardware) on your device (Computer, Mobile, Tablet, Laptop etc.), using which you are connecting to our applications.

It is the responsibility of potential buyer (a person or/and an entity that hires vehicle or/and equipment services) to check if the vehicle or/and equipment has the required licenses to conduct the business, latest taxes paid, pollution certificate, fitness certificate and other statutory related permissions. We do not take responsibility regarding this.
